Dividing Property in a San Diego Gray Divorce

California courts divide the community estate equally in divorce, while assets belonging to one spouse are generally confirmed to that spouse. Community property generally includes assets acquired during the marriage. Property owned before marriage or received as a gift or inheritance is generally treated as an individual asset, although its history can complicate that analysis.

We determine whether an asset or debt belongs to the community estate, one spouse, or both. This work can involve tracing transactions and reviewing commingling, which occurs when shared and individual funds are mixed. In high-net-worth divorces, we also address the valuation of real estate, businesses, investments, retirement accounts, income, and debts.

Financial records that may be important include:

  • Retirement and pension statements showing contributions and account activity
  • Real estate records concerning ownership, mortgage balances, and equity
  • Business and investment records relevant to ownership and value
  • Income documents and statements for significant debts

Retirement Accounts & Pensions in Later-Life Divorce

A retirement account’s entire balance isn’t automatically part of the marital estate. Contributions made during marriage are generally shared, while contributions made before marriage or after separation generally belong to the contributing spouse. Account statements and employment records can help establish when contributions were made.

Pensions may require a time-rule analysis. This calculation generally compares the employee’s total service with the service that overlapped the marriage to identify the marital share. The plan’s terms and the parties’ employment history affect how the pension is reviewed and divided.

Division doesn’t always require splitting every asset individually. An offset may allow one spouse to retain a retirement account while the other receives a comparably valued portion of another asset, such as home equity. Reliable valuation is essential because assets with similar stated values may have different features and future implications.

Retirement Division Orders After Divorce

A Qualified Domestic Relations Order, commonly called a QDRO, is a court order used to divide many employer-sponsored retirement plans between an employee spouse and an alternate payee. Most 401(k) plans and pensions generally require one. A plan administrator typically won’t release benefits to the non-employee spouse without an approved order that satisfies the plan’s requirements.

Not every retirement asset uses a QDRO. Traditional and Roth individual retirement accounts generally require a divorce-related trustee-to-trustee transfer rather than a QDRO for the transfer to remain tax-free under federal rules. Government retirement plans may require another document, such as a Domestic Relations Order or Court Order Acceptable for Processing.

Retirement-division documents should be completed rather than left unresolved after entry of the divorce judgment. The required language depends on the plan, the judgment, and the division method. Careful preparation helps ensure the order submitted to the plan administrator reflects the agreed or court-ordered allocation.

Spousal Support & the California Divorce Process

Spousal support is financial assistance that one spouse may pay to the other. California courts consider factors such as income, the length of the marriage, and the marital standard of living. A long marriage doesn’t automatically determine eligibility, amount, or duration, so we evaluate support based on the specific financial circumstances.

California is a no-fault divorce state, so a spouse doesn’t need to prove wrongdoing to obtain a divorce. Before marital status can be terminated, California generally requires a minimum six-month waiting period. Residency requirements also generally call for one spouse to have lived in California for at least six months and in the filing county for at least three months.

San Diego divorce cases are filed through the San Diego County Superior Court, Family Law Division. We begin by learning about your concerns, priorities, and financial circumstances. We then outline the likely procedural path and help you gather the records needed for disclosures, negotiations, and court filings.
